Are transfer payments in football ruled off-side by the ban on cartel formation?

The Diarra judgment, handed down by the Court of Justice of the EU on 04.10.2024, concerns not only the free movement of players, but equally, if not even more, whether clubs' access to their most important "resources" (the players) can be restricted by a requirement for a large transfer fee.

Has football´s transfer system been given the red card?

On 04.10.2024, the Court of Justice of the European Union issued a judgment that will probably be known as the Diarra judgment, and it will certainly change the current transfer system in football completely, while the consequences must be expected to be even more (financially) extensive than the Bosman judgment.

According to FIFA´s Football Agent Regulations, a Football Agent is “A natural person licensed by FIFA to perform Football Agent Services”.

According to FIFA´s Football Agent Regulations, Football Agent Services is defined as:” football-related services performed for or on behalf of a client, including negotiation, communication relating or preparatory to the same, or other related activity, with the purpose, objective and/or intention of concluding a Transaction”.  

Article 11 of the FIFA Football Agent Regulations states: ”Only a Football Agent may perform Football Agent Services.”

This means that only persons who have obtained a FIFA Football Agent license may perform football agent services. This means, among other things, that FIFA excludes lawyers without a FIFA Football Agent license from performing such services.
